Held & Hines, LLP Wins Once Again Against Uber In A Case of Likely FIrst Impression

In a case of likely first impression, Uber attempted to enforce an arbitration provision in their terms of service against a pedestrian in a car accident who was not taking an Uber ride nor a passenger in an Uber vehicle. In addition, Uber never served the accident victim with a Notice to Arbitrate.

On or about March, 25, 2026, the Supreme Court of New York, Kings County denied Ubers attempt to arbitrate holding that the service of the Arbitration Demand was improper under CPLR § 7503(c) and that Plaintiff had completed her Uber ride, was not a passenger in the vehicle at the time of the accideent and as such, was not covered by or subject to the arbitration provision of Uber’s terms of service.

As such, Uber;s attemot to expand the reach of its terms iof service was DENIED!
