Held & Hines, LLP Wins Landmark Trademark Federal Case
On May 29, 2015, Judge Caproni of the Southern Distruct Court ruled in favor of Sandy Hussain against MDB LLC aka GreenPearl, a company owned by former Property Shark CEO, Ryan Slack. The balance of the equities held in favor of Sandy Hussain who was held to be the inventor and owner of the trademark, “Fashion Digital.”
The Court specifically held, “The Clerk of Court is directed to enter judgment in favor of Hussain as to Count I of GreenPearl’s Complaint and as to Count I of Hussain’s Counterclaims. The Clerk of Court is further directed to close the open motion at docket entry 32, as GreenPearl’s Motion to Strike Hussain’s Answer is now moot. Both parties’ requests that the Court award them fees and costs in connection with the trial are DENIED. Hussain is ordered to file a proposed order by June 5, 2015 describing the particular parties and acts that she seeks to enjoin. Until a permanent injunction is entered, GreenPearl and Ryan Slack, together with GreenPearl’s officers, agents, servants, employees, affiliates, parent or subsidiary corporations, attorneys, and all those in privity with them, are temporarily enjoined from using the FASHION DIGITAL mark in any manner and for any purpose.”
