Personal Injury Case: FAQ

Common Questions You May Have in a Personal Injury Case:

If you’ve been injured and have decided to sue for personal injury, you likely have a lot of questions. This is especially true if this is the first time you’ve been involved in a case like this. Working with an attorney is the best way to get answers that are relevant to your case, but here are some common questions you’re likely to have.

How Long Will the Case Take?

This depends on whether or not your case goes to trial. In most cases, the two parties come to an agreement outside of the court. If your case is carefully presented and has the facts to back up what happened to you, it’s very likely that the other party will offer you a settlement instead of going to trial. You can reject that settlement, of course, but if you do, be aware that the trial can take a good amount of time. Some personal injury cases aren’t concluded for months. Often, the case will be settled within a couple of weeks.

How Much Money Will I Get?

This is also very case-dependent, but you can often get an idea of what the court may award you or what the other party may offer as a settlement. Add up your medical bills, your lost wages, the cost of physical therapy, and any other costs you incurred because of the accident. Then multiply that number by 1.5. This is a good idea of the minimum amount you may receive. However, again, keep in mind this can greatly vary from case to case.

Do I Need an Attorney?

You can file a personal injury case without a lawyer, but doing so can hurt your case. The other side is likely to have a lawyer, and the court won’t grant you any special favors for representing yourself. In fact, without an attorney familiar with personal injury cases on your side, you may make a number of mistakes or skip parts of the process that are absolutely vital to winning. Your entire case could be thrown out.

That’s why it’s always best to work with an expert. The attorneys at Held & Hines LLP are here to help with any personal injury case. Contact us today to discuss your needs.
