Someone is Suing Me for Personal Injury – What Do I Do?

No one wants to be handed paperwork and told that they’re being sued for personal injury. These types of cases often come after an auto accident, although there are many other cases that fall under personal injury. If you’re being sued for damages from this type of case, what do you do? The first thing is to keep as calm as possible. After that, there are a few other things you need to keep in mind.

Find any Information You Have

The long limitations on personal injury cases mean that you may be sued for something that happens months or even years ago. Trying to remember what happened on that day can be difficult, which is why you always want to keep any paperwork from an accident or incident in which someone was harmed. You will want to find your copy or request a new copy of any police report that was made as well as any other information you gathered at the time of the accident.

You will also want to look back at the conditions of the day, especially if you’re dealing with a car accident or a slip and fall that occurred outdoors. What is windy? Raining? Icy? What time did the accident occur, and what was the visibility at that time? Much of this information can be found online.

Who Was Involved?

If you had family, friends, or co-workers who were witnesses to the accident, make certain to contact them and let them know what is happening. You may need their testimony during the case. Also contact any doctors you saw and gather any receipts for bills you may have paid, including insurance claims.

Look for Photographs

Did you take any photographs the day of the accident? If so, make certain you can find them. If you know of anyone else who took photos of the scene, ask for copies. Photographic evidence is one of the most important things you can have in a case like this.
