Should I Appeal a Personal Injury Case?

Dealing with a personal injury case in stressful in a number of different ways. Besides going to court and handling all of the legal matters, you may also be dealing with pain, doctor appointments, and the stress of meeting your financial obligations while being unable to work. Then, on top of all of this, the judge or jury may find that you aren’t entitled to anything. What do you do if you lose your personal injury case? Should you try to appeal it?
Do You Have a Strong Case?
Is your case fairly convincing? If it’s a really strong case, you should have won, but there can be times where that doesn’t happen. If you and your attorney both believe that the verdict in your case was wrong, appealing makes sense. This is especially true if it seems like the judge or jury were swayed by something that had little to no bearing on the case. On an appeal, you not only have to prove your original case, but you also have to prove that the original verdict was incorrect. This is often much more difficult, especially if you can’t show clear errors or other issues with the verdict or case.
Are You Willing to Put in the Time and Money?
Appealing a case means it’s going to continue to play a part in your life. In fact, it could hang over your head for months or even years. If you were injured to the point that you cannot work or have limited mobility, it may be worth pursuing. If you weren’t, you’ll have to decide if it’s worth putting in the time and money to move forward with an appeal.
You Can Still Settle
If it’s fairly obvious that the original verdict will get overturned, it’s very likely that the other party involved will offer you an out-of-court settlement. You can take this settlement at any time and drop the appeal, or you can return to court. It’s all up to you. In other cases, the other party may decide that they feel an appellate court will uphold the verdict, so they may not offer to settle.
