Held & Hines’ Wins Motion On Behalf of Seller Precluding Buyer From Unilaterally Waiving A Mortgage Contingency Clause in Contract

In a Court ruling of April 10, 2017, Judge Wooten held in favor of Held & Hines denying Puchaser’s attempt for a preliminary injunction ruling that “a mortgage contingency clause was a condition precedent inuring to the benefit of both parties, and therefore couldn’t be waived unilaterally by buyer.” See Shtulman et al vs. Benjamin Smuk, S/Kings, APril 10, 2017 Decision.
