How Do I Appeal a Personal Injury Case?

If you’ve lost a personal injury case, you may want to appeal the decision. The outcome of this appeal may reverse the decision, awarding you damaging and other financial benefits. Know Your Deadlines

There is a deadline to file an appeal, so you have to make your decision to do so fairly quickly. In New York, you will receive a copy of what’s called the Order of Judgment. This is the official document informing you of the court’s decision. Once you have received this document, you have 30 days in which to file an official Notice of Appeal. If you don’t get this paperwork in on time, you cannot appeal the case.

Have the Necessary Information

Your Notice of Appeal needs to include a number of pieces of information. You will have to have the docket number and the official court name of your case, the judgment you want to appeal, the date that judgment was entered, the court you were in, and the court you’re appealing the case to. Now that you’ve officially entered your Notice of Appeal, it’s time to prepare for the case. Things will proceed in a fashion similar to the previous case.
