Stages of a Personal Injury Case
- Posted on:
Going through a personal injury case can seem overwhelming. However, each step of the process is extremely important to winning your case and getting you the compensation you deserve.
To help you better understand what a personal injury case will look like, here are the various steps you can expect to go through during your process.
1. Meeting With Your Attorney
Before you can begin anything else, you will need to meet with an attorney. During this time, your attorney can help you understand whether or not you truly have a case and help prepare you for the process ahead.
2. Filing Your Court Papers
To formally begin your personal injury case, you will need to file papers with the court. Your attorney can help you through this process to ensure you’re submitting the right documents at the right time.
3. Fact-Finding and Discovery
During fact-finding and discovery, you and your attorney will meet with the individual responsible for your injury and their legal team. At this stage, you will share facts about the case and ensure you’re moving forward on the same page.
4. Settlement
Many personal injury cases will never actually make it to trial. Instead, you and the responsible party can come to a settlement outside of court. A settlement allows you to agree on a sum of compensation without needing to go to court.
5. Trial
If you and the other individual cannot come to a settlement, you will need to go to trial. During the trial, you and your legal team will present the facts of the case while the other side will do the same. It will be up to a judge to decide who wins the case and the amount of compensation you deserve.
